Ms. Chitra Joshi, learned counsel holding brief of Mr.

Mukesh Singh Rawat, learned counsel for the Revisionist.

2. Mr. Vipul Painuly, learned AGA, for the State of Uttarakhand/1.

3. The present matter is listed for disposal of the delay condonation application (IA No.1/2025) moved on behalf of the Revisionist. The delay is of 133 days in filing the present revision.

4. This Court finds ground for condonation of the delay is sufficient. For the reasons indicated in the delay condonation application, the same is allowed, and the delay in filing criminal revision is hereby condoned.

5. The present criminal revision is directed against the judgment and order dated 23.04.2025, passed by the court of learned Family Judge, Haldwani, District Nainital, in Case No.251 of 2024, “Smt. Rupali & others Vs. Pramod Chauhan”, whereby directing the Revisionist to pay an amount of Rs.11,000/- per month as interim maintenance to the Respondents i.e. wife, sons and daughter respectively.

6. Admit.

7. Learned counsel for the Revisionist makes a submission that despite their minor children i.e. private Respondent Nos.3, 4 and 5, who have been impleaded as Respondents are staying with the Revisionist/Father and because they have also awarded a maintenance allowance alongwith Respondent No.2/Mother, therefore, they have been impleaded as formal party in the criminal revision.

8. Learned counsel for the Revisionist submits, at this juncture, that the impugned maintenance order dated 23.04.2025, is exorbitant and not legally sounds, as minor children mentioned above are staying with the Revisionist/Father, and he is being looking after.

9. Issue notice to the Respondent No.2. Steps to be taken within a week. Counter affidavit to be filed within a period of three weeks.

10. Considering the overall facts and circumstances of the case, an interference is being called for in the matter.

11. Till the next date of listing, the effect and operation of the impugned judgment and order dated 23.04.2025, passed by the court of learned Family Judge, Haldwani, District Nainital, in Case No.251 of 2024, “Smt. Rupali & others Vs. Pramod Chauhan”, shall remain stayed, subject to the condition that the Revisionist shall pay Rs.5,000/- per month as interim maintenance to the Respondents.

12. List this matter on 20.02.2026.
