The applicant- Salman is in judicial custody

for the offence punishable under Section 29 of the

Narcotic Drugs and Psychotropic Substances Act, 1985

in Case Crime No.386 of 2025, registered at Police

Station Bahadrabad, District Haridwar.

2. The First Bail Application (No.2032 of 2025)

was dismissed as withdrawn on 19.12.2025 granting

liberty to the applicant to file afresh.

3. According to the First Information Report

dated 05.10.2025, the police recovered 35.31 gm

smack from the co-accused Vijay Kumar. He was

arrested. Vijay Kumar told the police that he was going

to sell the recovered smack to Salman (applicant). He

and Salman sell smack in schools and colleges around

Roorkee.

4. Heard Mr. Mohd. Safdar, learned counsel for

the applicant and Mr. Sandeep Sharma, learned

Assistant Government Advocate for the respondent.

5. Mr. Mohd. Safdar, Advocate, contended that

the applicant has been falsely implicated by the co-

accused. Applicant was not involved in the said offence.

He is not a convicted person. He is a permanent

resident of District Haridwar, therefore, there is no

possibility of his absconding, and, he is in custody since

10.10.2025.

6. Mr. Sandeep Sharma, learned Assistant

Government Advocate, on instruction, submitted that

apart from the statements of the co-accused Vijay

Kumar, no other evidence has been found against the

applicant till date.

7. Having considered the submissions of learned

counsel for both the parties and in the facts and

circumstances of the case, without expressing any

opinion as to the merits of the case, this Court is of the

view that the applicant deserves bail at this stage.

8. The Bail Application is allowed.

9. Let the applicant – Salman be released on

bail on his executing a personal bond and furnishing

two reliable sureties, each in the like amount, to the

satisfaction of the court concerned.
