1. Mr. Aditya Singh, learned counsel

for the petitioner.

2. Mr. J.S. Virk, learned Additional

Advocate General for the State of

Uttarakhand.

3. Petitioner is running an Industrial

Unit, which runs a Manufacturing Unit.

According to petitioner, respondent nos.

4 & 5 are holding agitation in front of

factory premises of petitioner, due to

which the production in the

Manufacturing Unit is affected.

4. The reliefs, sought in the writ

petition, are as follows:-

(i) Issue a writ, order or direction, in the nature of

mandamus directing the Respondents No. 1 to 3

to ensure that no protest, picketing, or

demonstration takes place within 300 meters

radius of the Petitioner’s factory premises, so as

to unimpeded access to the premises and

prevent obstruction to lawful business

operations.

(ii) Issue a writ, order or direction, in the nature of

mandamus directing the Respondent No. 1 to 3

to provide adequate police protection to the

Petitioner, its management, staff, and goods

entering or existing the premises.

(iii) Issue a writ, order or direction, in the nature of

mandamus directing the Respondent No. 1 to 3

to provide strict action against Mr. Lalit Kumar

and all other persons named in the written

complaint or involved in the unlawful protest

under the relevant provision of the B.N.S. and

other applicable laws.

(iv) To grant ad interim ex-parte stay thereby

directing the respondents No. 1 to 3 to ensure

that no protect, picketing, or demonstration

takes place within 300 meters radius of the

Petitioner’s factory premises, so as to ensure

unimpeded access to the premises and prevent

obstruction to lawful business operations during

the pendency of the present writ petition.

5. Learned State Counsel has

produced in Court the written

instructions received from In-charge

Inspector, Kotwali, Manglour, which are

taken on record. Perusal of written

instructions reveals that there was an

Industrial unrest in Manufacturing Unit of

petitioner; however, the unrest has now

come to an end, after the Management

entered into a settlement with the

workers. The settlement was reportedly

entered on 20.12.2025.

6. Learned counsel for the petitioner

submits that there are certain persons,

who are still creating disturbance. He

submits that they be restrained from

holding demonstration, within 150

meters of main gate of the factory

premises.

7. The writ petition is, accordingly,

disposed of with a direction to Station

House Office, Manglour, District

Haridwar, not to permit any agitation,

demonstration etc. within 150 meters of

main gate of the Manufacturing Unit of

petitioner. The ingress and egress to the

Manufacturing Unit of the petitioner shall

be left open and no one may be

permitted to cause hindrance in the

same.
