2. Petitioner is serving as Livestock Extension Officer in Government Animal Service Centre, Kalinagar, District Udham Singh Nagar. He was transferred to Animal Service Centre Dalkanya, District Nainital in public interest vide order dated 10.06.2025. Feeling aggrieved by his transfer, petitioner

filed this writ petition.

3. Learned counsel for the petitioner submits that petitioner is a divorcee, therefore, he is protected by the provision contained in Section 13(6) of Uttarakhand Annual Transfer for Public

Servants Act, 2017.

4. Learned State Counsel, however, submits that as per the judgment enclosed (Annexure-3 to the writ petition), decree of divorce was passed by Family Court, Udham Singh Nagar only on 28.05.2025. Whether that judgment was challenged before some higher forum or any interim order was passed against the said

judgment, is not known.

5. Learned State Counsel further submits that petitioner has continuously served at Kalinagar for more than 11 years, therefore, he became due for transfer to a durgam place.

6. Since petitioner has served at Kalinagar for sufficient long period of time, therefore, this Court is not inclined to interfere in the matter. However, writ petition is disposed of by permitting the petitioner to make representation to the Additional Director, Animal Husbandary (respondent No. 2) in respect of his transfer. If he makes such representation within one week from today, decision thereupon shall be taken within four weeks thereafter.

7. Petitioner’s joining at the transferee place shall abide by the outcome of the representation.
