Instant appeal is preferred against the judgment and

order dated 18.03.2017 passed in O.S. No. 318 of 2012, Shri Chandar Singh v. Smt. Sushila, by the court of Principal Judge, Family Court, Dehradun, by which the petition under Section 13 (1) (i-a) (i-b) of the Hindu Marriage Act, 1955 (“the Act”) filed by the appellant has been

rejected.

2. The respondent has been served, but despite service, the

respondent is not represented in the appeal.

3. Heard learned counsel for the appellant and perused the

record.

4. The facts necessary to appreciate the controversy, briefly stated, are as follows. The appellant and the respondent were married on 04.05.1999. Both the parties were unmarried at the time of marriage. They were blessed with a baby boy Aditya (Anuj) on 18.04.2001. The appellant filed a petition seeking divorce on the

following grounds:-
