This Application under Section 482 of the

Code of Criminal Procedure, 1973 has been filed for quashing the entire proceedings of Criminal Case No.329 of 2019, pending before the court of Judicial Magistrate, Roorkee, District Haridwar under Sections 323, 504, 506, 498A of the Indian Penal Code, 1860, Section 3 and Section 4 of the Dowry Prohibition Act,

1961.

2. Mr. Mohd. Safdar, learned counsel for the

applicants-accused.

3. Mr. Pratiroop Pandey, learned Assistant

Government Advocate for the respondent no.1.

4. Mr. Bilal Ahmed, learned counsel for the respondent no.2/informant-victim.

5. Both, Mr. Mohd. Safdar, Advocate for the applicants and Mr. Bilal Ahmed, Advocate for the respondent no.2 submitted that the applicants and respondent no.2 have settled their matrimonial disputes and after resolving their disputes, they have filed a Compounding Application (IA No.4341 of 2023) and affidavits. They further submitted that the respondent no.2/informant–victim has filed her affidavit dated 04.04.2023. They submitted that the applicants and respondent no.2 have filed the Compounding Application (IA No.4341 of 2023) and affidavits with their free will and without any pressure.

6. Mr. Bilal Ahmed, Advocate has requested to quash the entire proceedings of Criminal Case No.329 of 2019 on the basis of the compounding application and affidavit of the respondent no.2.

7. The said request has not been opposed by the learned counsel for the State.

8. In the facts and circumstances of the case, ends of justice would be met if the entire proceedings of Criminal Case No.329 of 2019, pending before the court of Judicial Magistrate, Roorkee, District Haridwar, are quashed.

9. Resultantly, the present Application filed under Section 482 of the Code of Criminal Procedure, 1973 is allowed and the entire proceedings of Criminal Case No.329 of 2019, pending before the court of Judicial Magistrate, Roorkee, District Haridwar, are hereby quashed.
