(2) Petitioner was regular student of B.Sc. Course in DAV (PG) College, Dehradun. According to him, he could not appear in Integral Calculus paper of 1^st Semester and he appeared in the said subject as back paper in the 5^th Semester Examination conducted by the University, however marks for internal assessment of the said subject are not being added by the University with the marks which he scored

in the external examination.

(3) Learned Counsel for the University was asked to get instructions. On instructions, Mr. Gupta submits that the only objection the University has is that a candidate, who remains absent or unsuccessful in any paper in 1^st Semester Examination, can write that paper as back paper only in 3^rd Semester Examination and

not in 5^th Semester Examination.

(4) Learned Counsel for the petitioner submits that since petitioner has now cleared all the papers of B.Sc. Course and this submission is not disputed by learned Counsel for the University, therefore, denying benefit of internal assessment to the petitioner would be too pedantic approach, which will cost dearly to the

petitioner.

(5) Having regard to the facts and circumstances of the case, writ petition is disposed of with a direction to the University to declare the result of the petitioner after giving due credit to his internal assessment made in Integral Calculus subject within two weeks from the date of production of certified copy of this order.
