(2) Petitioner was regular student of B.Sc. Course in DAV (PG) College, Dehradun. According to him, he could not appear in Integral Calculus paper of 1st Semester and he appeared in the said subject as back paper in the 5th Semester Examination conducted by the University, however marks for internal assessment of the said subject are not being added by the University with the marks which he scored

in the external examination.

(3) Learned Counsel for the University was asked to get instructions. On instructions, Mr. Gupta submits that the only objection the University has is that a candidate, who remains absent or unsuccessful in any paper in 1st Semester Examination, can write that paper as back paper only in 3rd Semester Examination and

not in 5th Semester Examination.
