(2) According to petitioners, they were initially appointed as Assistant Teacher in Basic Schools run by Uttar Pradesh Basic Education Board and they were later appointed as Head Master in Junior Basic Schools and upon State reorganisation, status of government servant was conferred upon them by virtue of Section 58 of Uttarakhand School Education Act. Thus, according to petitioners, they are entitled to the benefit of past services rendered in Junior Basic Schools also while determining
their eligibility for selection grade.
(3) By means of this writ petition, petitioners have sought the following
reliefs:
“I- Issue a writ of mandamus,
commanding and directing the respondent to grant the benefit of Selection grade in the Grade pay of Rs. 5400/- by calculating the services rendered by the petitioners on the post of Headmaster in Government primary school/Assistant teacher Junior high school in the pay scale of Rs. 5500- 9000 before their merger in the cadre of Assistant teacher LT grade cadre, in the pay scale of Rs. 5500-9000 as has been granted to the similarly situated person by issuing
Government order from time to time.
II- Issue a writ of mandamus,
commanding and directing the respondent
to revise and re-fix the salary of the petitioners by granting the benefit of the grade pay of Rs. 5400/- from the date petitioners were placed in the pay scale of Rs. 5500-9000/-.”
(4) Learned State Counsel submits that since petitioners have sought a writ of mandamus and they have also made representations before the competent authority, therefore, writ petition may be disposed of with a direction to competent authority to examine the claim of petitioners.
(5) Accordingly, writ petition is disposed of by directing Additional Director of Education, Garhwal Region, Pauri to consider and decide representation submitted by the petitioners within six months from the date of production of certified copy of this order.
