2. Petitioner claims to be the wife of Yameen Ali, who died on 25.11.2024. Since name of petitioner is not registered in the family register, therefore, she has approached this Court seeking a direction to competent authority, to record her

name in the family register.

3. Learned State Counsel points out that due to differences with her husband, petitioner was residing with her parents in District Bijnor and petitioner’s husband had remarried. However, the relationship of husband and wife was

subsisting between petitioner and late Yameen.

4. Learned counsel for the petitioner submits that Sub Divisional Magistrate, Laksar District Haridwar, had called a report from Assistant Development Officer (Panchayat) on petitioner’s application. Learned State Counsel, however, submits that Sub Divisional Magistrate has no role to play in the matter and petitioner should have made application to Gram Panchayat Adhikari of the concerned

Gram Panchayat.

5. This Court finds substance in the submission made by learned State Counsel.

6. The writ petition is, accordingly, disposed of with liberty to petitioner to make application to Gram Panchayat Adhikari, for entering her name in the family register of her-in-laws.

7. If she makes such application within two weeks from today, Gram Panchayat Adhikari of concerned Gram Panchayat shall examine the matter and pass appropriate order, as per law, within eight weeks from date of presentation of certified copy of this order.

8. Other stakeholders, including other wives of late Yameen, shall also be given opportunity of hearing by the Gram Panchayat Adhikari, before taking any decision in the matter.
