The applicant was granted bail in the

FIR/Case Crime No.584 of 2023, dated 10.10.2023, under Sections 320, 201 read with Section 34 IPC, Police Station Patel Nagar, District Dehradun based on the Sessions Trial No.17 of 2024, State of Uttarakhand Vs. Ashish alias Pappu, pending in the court of 5^th Additional

Sessions Judge, Dehradun.

It is submitted that, in fact, a charge-sheet

has been filed under Sections 302, 201 read with Section 34 IPC. It is apparent from the bail

rejection order, as well.

Now, a modification application has been filed

so that the order may be modified for the offences under Section 302 and 201 read with Section 34

IPC.

Learned counsel for the applicant submits

that, in fact, in the instant matter, the FIR was lodged on 10.10.2023, under Sections 302, 201 read with Section 34 IPC, but the Charge Sheet was submitted under Sections 302, 201 read w
