2. Mr. S.S. Chauhan, learned Deputy Advocate General assisted by Mr. Vikash Uniyal, learned Brief Holder for the State
of Uttarakhand.
3. The present Criminal Writ Petition, filed under Article 226 of the Constitution of India, has been instituted with the
following prayers:
“(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned F.I.R. No. 063 of 2025 dated 18.12.2025, under Section 318(4) of B.N.S., 2023 at
P.S. Gangnahar, District Haridwar.
(ii)Issue an appropriate, writ order or direction to the respondent nos. 1 and 2 not to take any coercive action against the petitioner in pursuance to the impugned FIR No. 0630/2025 dated 18.12.2025 under Section 318 (4) of
B.N.S., 2023, P.S. Gangnahar, District Haridwar.”
4. The Petitioner has also filed a Stay Application (I.A. No. 01 of 2026), seeking a stay of his arrest in pursuance of the FIR No. 0630 of 2025 dated 18.12.2025, under Section 318 (4) of
