Kapri, learned counsel for the Petitioner.

2. Mr. S.S. Chauhan, learned Deputy Advocate General assisted by Mr. Vikash Uniyal, learned Brief Holder for the State

of Uttarakhand.

3. The present Criminal Writ Petition, filed under Article 226 of the Constitution of India, has been instituted with the

following prayers:

“(i) Issue an order, direction or writ in the nature of certiorari quashing the First Information Report dated 31.10.2025 lodged by the respondent no. 3 as F.I.R. No. 56 of 2025, under Section 318(4), 336 (3), 338, 340 (2) of B.N.S., 2023, P.S. Kotwali, Champawat, District

Champawat, against the Petitoner.

(ii) Issue an order, direction or writ in the nature of mandamus directing Respondent No. 1 & 2 not to arrest the petitioner in First Information Report dated 31.10.2025 lodged by the respondent No. 3 as F.I.R. No. 56 of 2025, under Section 318(4), 336 (3), 338, 340 (2) of B.N.S., 2023, P.S.. Kotwali, Champawat, District

Champawat, against the Petitoner”

4. The Petitioner has also filed a Stay Application (I.A. No. 01 of 2026), seeking a stay of his arrest in pursuance of the F.I.R. No. 56 of 2025, under Section 318(4), 336 (3), 338, 340 (2) of

B.N.S., 2023, P.S, Kotwali, Champawat, District Champawat.

5. Admit.

6. Issue notice to Respondent No. 3. Steps to be taken within

a week.

7. Let objections be filed by the Respondents.

8. Considering the facts and circumstances of the case, as an interim measure, it is directed that till the next date of listing, no coercive measures shall be taken against the Petitioner, subject to

the condition that the Petitioner shall cooperate with the investigation. In the event of non-cooperation, the interim protection so granted shall stand automatically vacated.

9. The Stay Application stands disposed of accordingly.

10. List this case on 30.03.2026.
