for the petitioners.

no. 1.

3. Mr. I.D. Paliwal, learned Standing Counsel accepts notice for respondent

no. 2.

5. By the instant petition the petitioner is praying for the following

relief:-

To issue a writ order or direction in

the nature of mandamus commanding and directing the respondent authorities to forthwith sanction the family pension to the petitioner and to regularly

disburse the same.

6. On the previous date Mr. I.D. Paliwal, learned Standing Counsel for the State of U.P. was directed to get instructions from respondent no. 2. Today, Mr. I.D. Paliwal, on written instructions of the Director apprise to this Court that the family pension has already been sanctioned to the petitioner by the Joint Director (Pension) and the communication thereof was also sent to the Chief/Senior Treasury Officer, Nainital

by office letter dated 08.01.2026.

7. Since, the substantial grievance of the petitioner has been redressed, there is no useful purpose to keep this petition pending but taking into consideration that the matter relates to the family pension and the petitioner is 93%

disabled, the concerned Chief/Senior Treasury Officer to whom Joint Director, (Pension) issued the instructions by office letter dated 08.01.2026 is directed to expedite the rest of the proceedings and release the family pension forthwith without any delay. The petitioner shall produce copy of this order to the Chief Treasury Officer and after receiving the order, the Chief Treasurer Officer shall proceed and release the pension forthwith.

8. Subject to the direction and observation as above, the instant writ petition is disposed of finally.
