2. Mr. S.S. Chauhan, learned Deputy Advocate General assisted by Mr. Vikash Uniyal, learned Brief Holder for the State
of Uttarakhand.
3. The present Criminal Writ Petition, filed under Article 226 of the Constitution of India, has been instituted with the
following prayers:
“(i) Issue a writ order or direction in the nature of Certiorari quashing the impugned FIR dated 01.01.2026 registered as Case Crime No. 0001 of 2026 under Section 2 (b)(xi) read with Section 3 of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 Police Station
Buggawala District Haridwar.
(ii)Issue a writ order or direction in the nature of mandamus commanding the respondents not to arrest the petitioner in Case Crime No. 0001 of 2026 under Section 2 (b)(xi) read with Section 3 of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986 Police Station Buggawala District Haridwar till the pendency of present
Petition.”
4. The Petitioner has also filed a Stay Application (I.A. No. 01 of 2026), seeking a stay of his arrest in pursuance of the Case Crime No. 0001 of 2026, for the offence punishable under Section 2 (b)(xi) read with Section 3 of U.P. Gangster and Anti Social Activities (Prevention) Act, 1986, registered at Police
Station Buggawala District Haridwar.
5. Admit.
6. Let objections be filed by the Respondents.
7. Considering the facts and circumstances of the case, as an interim measure, it is directed that till the next date of listing, no coercive measures shall be taken against the Petitioner, subject to the condition that the Petitioner shall cooperate with the
investigation. In the event of non-cooperation, the interim protection so granted shall stand automatically vacated.
8. The Stay Application stands disposed of accordingly.
9. List this case on 27.03.2026.
