Petitioner.
2. Mr. Amit Bhatt, learned G.A. assisted by Mr. Kuldeep Rawat, learned A.G.A and Mr. B.C. Joshi, learned A.G.A. for the State of
Uttarakhand.
3. The present Criminal Writ Petition, filed under Article 226 of the Constitution of India, has been instituted with the following
prayers:
“(i) Issue a writ, order or direction in the nature of certiorari quashing the First Information Report lodged by respondent no. 4 registered as FIR No. 534 of 2025 dated 24.12.2025 U/s 248(b), 3(5) and 336(4) of B.N.S, 2023 at P.S. Bahadrabad,
District Haridwar.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent No. 2 and 3 not to arrest the Petitioner in pursuance to the First Information Report lodged by respondent no. 4 registered as FIR No. 534 of 2025 dated 24.12.2025 U/s 248(b), 3(5) and 336(4) of B.N.S, 2023 at P.S.
Bahadrabad, District Haridwar.”
4. The Petitioner has also filed an Interim Relief Application (I.A. No. 01 of 2026), seeking a stay of his arrest in pursuance of the impugned FIR No. 534 of 2025 dated 24.12.2025, registered under Sections 248(b), 3(5) and 336(4) of the B.N.S., 2023 at Police Station
Bahadrabad, District Haridwar.
5. Admit.
6. Issue notice to Respondent No. 4. Steps to be taken within a
week.
7. Let objections be filed by the Respondent.
8. Considering the facts and circumstances of the case, as an interim measure, it is directed that till the next date of listing, no coercive measures shall be taken against the Petitioner, subject to the condition that the Petitioner shall cooperate with the investigation. In the event of non-cooperation, the interim protection so granted shall
stand automatically vacated.
9. An Interim Relief Application stands disposed of accordingly.
10. List this case on 24.03.2026.
