2. Mr. S.S. Chauhan, learned Deputy Advocate General assisted by Mr. Vikash Uniyal, learned Brief Holder for the State of Uttarakhand.
3. The Applicant is an accused in connection with FIR No. 0029 of 2026 dated 11.02.2026, registered under Section 103(1) of the Bharatiya Nyaya Sanhita, 2023, at Police Station Dalanwala, District Dehradun.
4. Learned counsel for the Applicant submits that the present Applicant seeks short-term bail to enable the Applicant to participate in the last rites ceremony of her deceased son on sympathetic grounds.
5. Learned State Counsel vehemently opposes the short-term bail application, contending that the Applicant is the main accused in a heinous offence and that the proper forum for seeking such relief would have been the Trial Court at the first instance.
6. Considering the aforesaid circumstances, the short-term bail application (BAST) is allowed to a limited extent. The Applicant shall be permitted to attend the said last rites ceremony strictly under police custody and shall not be released on bail. Immediately after the ceremony, she shall be taken back into judicial custody.
7. It is clarified that this order is being passed without going into the merits of the case. Considering that the Applicant is alleged to be the prime accused in the said offence, the Senior Superintendent of Police, Dehradun, is directed to take all necessary precautions and ensure adequate security arrangements in the present matter.
8. In view of the above, BAST (Short-Term Bail Application No. 06 of 2026) stands disposed of.
