1. Mr. Susheel Kumar, learned counsel holding the brief of Mr. Gaurav Singh, learned counsel for the petitioners.

2. Mr. Tumul Nainwal, learned A.G.A. with Ms. Sweta Badola Dobhal, learned Brief Holder for the State.

3. The instant writ petition has been preferred by the petitioner Sajiya, D/o Musharraf and Mohd. Kasif, S/o Mohd.

Sharafat with following reliefs:-

(i) Issue a writ order or direction in the nature of mandamus directing the respondents no. 1 & 2 to provide adequate protection to the petitioners from respondent No. 3 along with other relative of petitioner no. 2 so that they may live peaceful life.

(ii) Issue a suitable writ order or direction which this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case.

4. It is argued by the learned counsel for the petitioner that both the petitioners are major and in support of their age copy of Aadhar card has been placed on record. As per the Aadhar card, date of birth of petitioner no. 1 is 01.01.2006 and so far as petitioner no. 2 is concerned his date of birth is 10.01.2007. He submits that according to their date of birth both the petitioner are major. It is contended that both married with each other without any pressure but there is threat perception from respondent no. 3, father of petitioner no. 2

5. The Nikahnama is also placed on record according to which both were married on 16.02.2026 at Dadubas Masjid Lalwala, Tehsil Haridwar District Haridwar in the presence of Qazi Mohd. Shahdeen, S/o Liyakat.

6. Both the petitioners are present in Court and are identified by their counsel.

7. This Court also interact with each of them and both of them submits that they were in love and now married with each other without any coercion.

8. Admittedly as per the documents, as enclosed in the petition, both the petitioners are major and both of them married in the Masjid and, in such an eventuality, if there is a threat perception from the side of the private respondents then the State is under legal obligation to ensure safety and protection of the petitioners.

9. Accordingly, I dispose of the instant writ petition with the direction to respondent no. 1 and 2 to make an assessment of threat perception received by the petitioners and to make an arrangement for their protection from any threat which may come from respondent no. 3. The S.H.O. P.S. Bhagwanpur, District Haridwar shall call respondent no. 3 to the police station and counsel him not to take law in his hands.

10. The petition is disposed of finally in the aforesaid terms.
