This Contempt Petition has been filed alleging wilful disobedience of the order dated 09.04.2024, passed in WPMS No. 807 of 2024. By the said order, following directions were issued:-

“6. The writ petition is, therefore, disposed of with a direction to the competent authority to consider claim of the petitioners for allotment, whenever the exercise for allotting land under Section 198 of ZA&LR Act is undertaken. District Magistrate, Udham Singh Nagar is directed not to divert the surplus land for purposes not permitted by law.”

2. Heard Mr. I.D. Paliwal, learned counsel for the petitioners and Mr. C.S. Rawat, learned Chief Standing Counsel for the respondent nos. 1 and 3.

3. Mr. Abhay Pratap Singh, Sub-Divisional-

Magistrate, Kashipur, District Udham Singh Nagar is present in-person.

4. In response to the Contempt Petition, a response affidavit dated 11.02.2026 has been filed by Mr. Abhay Pratap Singh, Sub Divisional Magistrate, respondent no.1 and one response affidavit dated 11.02.2026 has been filed by Mr. Pankaj Chandola, Tehsildar Kashipur, District Udham Singh Nagar, the respondent no.3.

As per the response affidavits, no process of allotment of land under Section 198 of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950 (as applicable in the State of Uttarakhand) is undertaken by the authorities in Tehsil Kashipur after passing the said order dated 09.04.2024. It is also mentioned in the response affidavits that as and when the exercise for allotting the land under Section 198 of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950 will be initiated by the authorities in Tehsil Kashipur, District Udham Singh Nagar, the claim of the petitioners will be considered by the authorities in compliance of the said order dated 09.04.2024.

6. Mr. I.D. Paliwal, Advocate, submitted on instructions that in view of the undertaking given by the respondent no.1 and respondent no.3, the petitioners do not want to pursue the present petition further.

7. For the foregoing reasons, this Contempt Petition does not require any further consideration. Therefore, the proceedings in the present Contempt Petition are closed.
