1. Mr. Kurban Ali, learned counsel for the revisionist.

2. Mr. Piyush Garg, learned counsel for the respondent.

3. The instant revision has been preferred under Section 25 of the Provincial Small Causes Courts Act, 1887 against the judgment and order dated 31.10.2025, passed by Judge, Small Causes Court (District Judge) Pauri Garhwal in SCC Case No. 03 of 2022, titled as “Anil Kumar vs. Arvind”.

4. On the previous date, the learned counsel for the revisionist was directed to get the instruction within how much period the revisionist shall vacate the shop in question.

5. Today, the revisionist is present in Court, and prayed that he will vacate the Shop in question on or before 31.05.2028 without causing any damages to the shop in question and will pay the monthly rent at the rate of Rs. 2,500/- per month from

1st December 2025.

6. Mr. Piyush Garg, learned counsel for the respondent, on instructions, accepts the proposal of the revisionist.

7. In such view of the matter and taking into consideration the undertaking as given by the revisionist, two and half years’ time is granted to the revisionist to vacate the shop in question, i.e., on or before 31.05.2028 and also directed to pay monthly rent at the rate of Rs. 2,500/- per month from 1st December

2025.

8. In reference to the aforesaid undertaking, the revisionist is directed to file the undertaking along with an affidavit before the SCC Court positively within two weeks from today.

9. It is made clear that no further time shall be granted to the revisionist in any manner and the revisionist has to vacate the shop in question on or before 31.05.2028, failing which the respondent is free to take the assistance of police.

10. Subject to the observation and direction as above, the instant civil revision is disposed of finally. Pending application, if any, also stands disposed of.
