(2) Petitioner, who was serving as Paryavaran Mitra in Nagar Palika Parishad, Nainital, retired on 30.4.2025. Since his retiral dues have not been cleared so far, therefore, he has approached this Court claiming the following reliefs:

“(i) a suitable writ order or direction in the nature of mandamus commanding the respondents to pay the entire amount of retiral benefits i.e. sanctioned and approved amount of Gratuity to the tune of Rs. 10,63,920-00 and arrear of pension Rs. 20,800-00 per months since the date of retirement of the petitioner with applicable interest payable thereon till final payment of the said amount and further direct to continue pay the pension as and when the same fell due.

(ii) a suitable writ order or direction in the nature of mandamus commanding the respondents to calculate and determine the amount of leave encashment and make payment of the same to the petitioner with applicable interest thereon within a period as stipulated by this Hon’ble court.”
