4. The present applicant Devendra Kumar, S/o Anand Pal is praying for bail in reference to FIR dated 25.09.2024, bearing FIR/Case Crime No. 951 of 2024 at P.S. Kotwali Manglaur, District Haridwar, wherein the applicant along with others have been implicated for the offences punishable under Sections 115(2), 190, 191(2), 191(3), 351(2), 333 and 352 of BNS 2023.

Learned counsel for the applicant submits that the present applicant is under treatment since there is regular bleeding from his nose and he is under regular treatment in the JNSM government hospital and certain documents have also been shown to this Court, from which it reveals that the applicant was brought by police to the JNSM government hospital Roorkee for medical treatment. He further submits that considering the medical condition of the applicant, he may be enlarged on interim bail for 45 days.

6. On the other side, the counsel for the State have not seriously opposed the interim bail considering the health condition of the applicant.

7. After taking into consideration that the applicant is under the regular treatment in JNSM Government hospital Roorkee and he was also referred to Surgeon by the medical officer of sub jail Roorkee, this Court is of the view that the present applicant be released on interim bail for a period of 45days.

8. Let the applicant Devendra Kumar S/o Anand Pal be released on interim bail for a period of 45 days, to be reckoned from the date of release, on his executing a personal bond to the satisfaction of the court concerned.

9. Needless to say, on completion of period of 45 days, from the date of release, he shall surrender before the court concerned. On such an event he will be remanded to the custody. If he does not surrender, proper warrant shall be issued against him.
