1. Mr. B.S. Koranga, learned counsel for the revisionist.

2. Mr. B.C. Joshi, learned A.G.A with Mrs. Meenakshi Sharma, learned Brief Holder for the State.

The instant criminal revision has been preferred by the revisionist against the judgment and order dated 29.11.2025 passed by the learned Chief Judicial Magistrate Champawat in Criminal Case No. 79 of 2019 as well as the judgment and order passed by the learned Sessions Judge dated 17.03.2026 in Criminal Appeal No. 68 of 2025. The revisionist has been convicted by the trial court with the maximum sentence of one year simple imprisonment with the fine of Rs. 40,000/, and in default of payment of fine he has to further undergo for a period of one month simple imprisonment, for the offence punishable under Section 279, 337, 338 and 304-A of IPC confirmed by the learned Sessions Judge.

4. As per office report, the revision is well within time.

7. Learned counsel for the applicant submits that the revisionist was on bail during trial which has not been disputed by learned A.G.A.

8. Taking into consideration that the revisionist was on bail during trial, this Court is of the view that the revisionist deserves for bail.

9. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. Let the revisionist Bhuwan Chandra Tiwari @ Bhaskar Tiwari be released on bail during the pendency of instant revision on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
