This writ petition has been filed under Article 226 of the Constitution of India, on the premise that without acquiring the land of the petitioner, comprised in Khata No.34/3 and 34/4, ad-measuring 2.309 hectare, Khewat No.3 mahaal, Area- Malakpur Latifpur, Village- Khanjarpur, Tehsil-Roorkee, District-Haridwar, a bridge is being constructed by the respondents.

4. Learned counsel for the State submits that from the record of the writ petition, it transpires that an application under Section 41 of the U.P. Land Revenue Act, 1901, is pending with the learned Assistant Collector, Ist Class, Roorkee, District-Haridwar and until and unless the demarcation is not made by the Competent Authority it cannot be said that the aforesaid land belongs to the petitioner.

5. Having argued vehemently at length, learned counsel for the petitioner seeks permission to withdraw the writ petition so that he may avail the remedy of expediting the proceedings under Section 41 of the U.P. Land Revenue Act, 1901, pending before the learned Assistant Collector, Ist Class, Roorkee, District-Haridwar.

6. Permission so sought for is granted.

7. Accordingly writ petition is dismissed as withdrawn with liberty as aforesaid.
