1. Mr. Anand Kumar Pandey, learned counsel for the petitioner.

2. Ms. Sweta Dobhal, learned Brief Holder for the State.

3. By the instant writ petition, the petitioners are praying for the following relief:-

To issue a writ order or direction in the nature of mandamus directing the respondent no. 2 & 3 to give police protection to the petitioners.

4. It is submitted by the learned counsel for the petitioners that both the petitioners are major and they married with each other on their own choice without any compulsion. In support of birth certificate the High School certificate of petitioner no. 1 is enclosed according to which the date of birth of petitioner no. 1 is 25.10.2007 and she became major in October 2025. So far as petitioner no. 2 is concerned, in support of date of birth copy of Aadhar Card is enclosed according to which his date of birth is 02.05.2004.

5. On the basis of aforesaid two documents, admittedly both the petitioners are major. In support of marriage certain photographs along with receipt of a Temple, namely, Shakti Mandir, Pantnagar SIDCUL dated

16.02.2026 is also enclosed.

6. It is submitted that both the petitioners belongs to same religion, however, respondent no. 4 and 5, the parents of petitioner no. 1 were not agreed for this marriage and now there is threat perception from respondent no.

4 and 5 and in this regard written complaint was made to the S.S.P. Udham Singh Nagar.

7. Both the petitioners are present in Court and identified by their counsel.

8. Taking into consideration the age of the petitioners, the State agency is under legal obligation to make an arrangement of their safety.

9. In such view of the matter, the instant writ petition is disposed of finally with the direction to the S.S.P. Udham Singh Nagar to assess whether there is any threat perception to the petitioners from respondent no. 4 and 5 and if he comes to the conclusion that there is a threat perception take necessary steps to secure their life and liberty. In addition to this respondent no. 3- S.H.O. Transit Camp District U.S. Nagar is also directed to call upon respondent no. 4 and 5 and to advice them not to take law in their hands.

10. Pending application, if any, also stands disposed of.
