3. Petitioner’s husband was employed as Head Constable in Civil Police, who died in harness, on 24.02.2024. Petitioner applied for compassionate appointment on 27.04.2024. Her prayer was turned down by order dated 06.06.2024, by relying on decision taken by Police Establishment Committee, on 22.05.2024, wherein it was provided that henceforth upper age limit for compassionate appointment on the post of Constable (M)/ Constable shall be 40 years.
4. Admittedly, petitioner had completed 42 years at the time she made application for compassionate appointment.
5. Learned counsel for the petitioner submits that earlier, there was no upper age limit prescribed for compassionate appointment, therefore, the upper age limit prescribed by the Police Establishment Committee in its decision dated 22.05.2024 cannot be made retrospectively applicable to the application of
