The petitioner Sohil preferred this writ petition for quashing of first information report dated 18.02.2026 bearing FIR No. 0052 of 2026, P.S.Kichcha District Udham Singh Nagar wherein the petitioner has been implicated for the offences punishable under Sections 5/6 of POCSO Act read with Section 351(2) read with Section 64 of Bharatiya Nyaya Sanhita, 2023.

5. The petition is supported with compounding application with the affidavit of the respondent no.4, the complainant/victim. In the compounding application both the parties are present in Court and identified by their counsels. It is contended in the compounding application that in fact both of them were in love but due to some differences between them, the FIR was lodged on 18.02.2026 at Police Station Kichha but subsequent thereto on 22.02.2026 both of them got married and Nikah Nama is also placed on record. Their marriage also registered in the office of the Sub-Registrar, Registration of Marriage, Kicha, District Udham Singh Nagar on 27.02.2026, which is annexed as Annexure 4. In support of the age, copy of Aadhar Card of both of them have also been enclosed and as per the Aadhar card date of birth of petitioner is 04.09.2001, and date of birth of the respondent-complainant/victim is 30.06.2007. The photocopy of the Aadhar Card are placed on record.

Learned counsel for the State submits that though the offences are not compoundable since at the time of incident the complainant was minor but now, as both of them are married with each other and their marriage is also registered and furthermore, as per the Aadhar Card both of them on the date of marriage were major, therefore, there is no useful purpose to proceed with the investigation. This Court is also interact with both of them, particularly to the respondent- complainant who also submits that she married with the petitioner and she does not want to pursue this FIR.

In such view of the matter, since the parties have settled their dispute and now married with each other, and their marriage is also registered and, furthermore, on the date of the marriage both of them were major, this Court is of the view that the compounding application as well as writ petition deserves to be allowed.

8. Accordingly, the writ petition as well as the compounding application are allowed and the impugned first information report dated 18.02.2026 bearing FIR No. 0052 of 2026, P.S. Kichcha District Udham Singh Nagar is hereby quashed.
