Counsel for the petitioner : Mr. Harshit Sanwal, learned counsel

Brief Holder for the State
: Mr. Suresh Chandra Bhatt, learned
counsel for respondent No. 2
The Court m ade the follow ing:
JUDGMENT: (per Sri Manoj Kumar Gupta, C.J.)
1) Although several prayers have been made in the
writ petition but the essential relief being claimed by the
petitioner is for registration of his firm as a contractor by
Nagar Palika Parishad for the year 2026-27. In the past
the petitioner had approached this Court by filing WPMS
No. 518 of 2026, being aggrieved by a notice issued by
Nagar Palika Parishad which provided that only persons
who were registered prior to year 2023-24 would be
entitled to apply for registration. The case of the

petitioner in the said writ petition was that he had worked
with Nagar Palika Parishad in the years 2023-24 and
2024-25 and therefore he should be granted registration.
In the said writ petition, the Nagar Palika Parishad took
the stand that registration of the petitioner had been done
and only his name is to be published in the Gazette as per
rules. In view of the said stand of Nagar Palika Parishad,
the writ petition was disposed of with liberty to the
petitioner to make representation with further direction to
the respondents to decide the same within 15 days by a
speaking and reasoned order. The petitioner on basis of
the liberty granted by this Court vide order dated
06.04.2026, in WPMS No. 518 of 2026, made
representation for notifying his firm’s name in the
Gazette. In the meantime, a public notice came to be
issued on 16.04.2026 by Executive Officer of Nagar Palika
Parishad, Khatima, Udham Singh Nagar, in which again
condition was imposed to the effect that only those
contractors who were having registration in the year
2025-26 can apply for renewal between 24.04.2026 and
25.04.2026. According to the petitioner, he applied for
registration of his firm on 24.04.2026 well within
prescribed time. However, the respondents have not

renewed the registration of the petitioner firm and, hence,
the present writ petition.
2) Learned counsel for the Nagar Palika Parishad
seeks time to obtain instructions.
3) In our opinion, interest of justice would be sub-
served in directing the Nagar Palika Parishad to pass a
speaking order on the application of the petitioner for
renewal of registration of his firm.
4) Accordingly, without expressing any opinion on
merits, the writ petition is disposed of with direction to
respondent No. 2 to pass a speaking order on the
application of the petitioner dated 24.04.2026 (Annexure-
15) within a period of two weeks from the date of
communication of the instant order.
5) Pending application(s), if any, also stand
disposed of.
