learned counsel for the Applicant.
2. Mr. S.S. Chauhan, learned Deputy
Advocate General assisted by Mr. Vikas Uniyal,
learned Brief Holder for the State.
3. Present bail application is moved by the
applicant, who is in judicial custody in
connection with FIR No.11 of 2023 under
Section 2/3 of The Uttar Pradesh Gangsters and
Anti-Social Activities (Prevention) Act, P.S.
Kotwali Pithoragarh.
4. Learned counsel for the applicant submits
that it is a case of parity as all the co-accused
persons have already been released on bail by
the trial court. He submits that present applicant
is also entitled to be released on bail on the
ground of parity.
5. Learned State Counsel however refutes to
the said submission and countered with the
submission that the present applicant is the main
accused.
6. Having heard learned counsel for the
parties and considering the overall facts and
circumstances of the case, this Court is of the
view that applicant is entitled to be released on
bail.
7. Accordingly, bail application is allowed. Let
the applicant-Jagdish Chandra Punetha be
released on bail on his executing a personal
bond and two reliable sureties of the like amount
to the satisfaction of the court concerned.
