This Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed for regular bail in connection with the Case Crime No.4 of 2025, registered at police station I.T.I., District Udham Singh Nagar under Section 3/5/11(1) of the Uttarakhand Protection of Cow Progeny Act, 2007.
2. A secret information was received by the police party on 03.01.2025. The police party raided the spot. The present applicant and three co-accused persons were arrested on the spot. The police party recovered 30 kg. of beef and cutting equipments etc.
from the spot.
3. Heard Mr. Sanjay Kumar, learned counsel for the applicant and Mr. G.S. Sandhu, learned Additional Advocate General with Mr. Deepak Bharadwaj, learned Brief Holder for the State.
4. Mr. Sanjay Kumar, Advocate, has submitted that the applicant is an innocent person. He has been falsely implicated in the present matter. He does not have any criminal antecedents. He was not present on the spot. He is a permanent resident of District Moradabad, therefore, there is no likelihood of his absconding, and, two co-accused have been granted regular bail by this Court.
5. Mr. G.S. Sandhu, learned Additional Advocate General, on the other hand, has opposed the bail application orally.
6. Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage.
7. The Bail Application is allowed.
8. Let the applicant – Shahnawaj be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
