This petition has been filed under Article 226 of the Constitution of India with the following prayers :-

“(I) Issue a writ, order or direction in the nature of mandamus directing the respondents to pay prevailing the minimum of pay scale as per recommendation of 7^th pay commission alongwith arrears as per recommendation of 6^th and 7^th pay commission with dearness allowances alongwith all consequential benefits to the petitioners as being paid to the regular appointed employees working in the department alongwith rate of interest.

(II) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 & 3 to decide the representations of the petitioners.

(III) Issue any other order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case.

(IV) Award the cost of the writ petition to the petitioner.”

2. The present Writ Petition was dismissed as withdrawn on 04.03.2025 in relation to the petitioner no.3 Sita Ram and petitioner no.5 Anusuya Prasad.

3. Heard Mr. Anil Anthwal, learned counsel for the petitioner no.1-Tej Ram and petitioner no.4-Smt. Pushpa Devi, Mr. Pankaj Miglani, learned counsel for the petitioner no.2-Ramesh Chand and Mr. G.S. Negi, learned Addl. C.S.C. for the respondents.

4. Mr. Anil Anthwal, Advocate and Mr. Pankaj Miglani, Advocate, have requested on instructions to decide the present Writ Petition directing the Chief Engineer, Irrigation Department, Dehradun/respondent no.2 to decide the representations of the petitioners for which the petitioners shall submit their fresh representations within two weeks’ from today.

5. Mr. G.S. Negi, Advocate has sought six weeks’ time for the respondent no.2 to decide the representations of the petitioners.

6. On the request of both the parties, the present Writ Petition (WPMS No.34 of 2021) is decided with a direction that if the petitioners Tej Ram, Ramesh Chand and Smt. Pushpa Devi submit their fresh representations within two weeks’ from today, the petitioners’ representations shall be decided by the Chief Engineer, Irrigation Department, Dehradun/respondent no.2 in accordance with law and as expeditiously as possible but not later than six weeks’ from the date of production of certified copy of this order along with representations.

7. It is made clear that this Court has not expressed any opinion on the merits of the case.
