2. Mr. Akshay Latwal, learned AGA for the State.
3. Applicant- Monu @ Sonu, who is in judicial custody in connection with Case Crime/FIR No. 163 of 2024, under Sections 392 and 411 of IPC, registered at Police Station Bahadrabad, District Haridwar, has sought his release on bail.
4. Heard learned counsel for the parties and perused the material available on record.

Learned counsel for the applicant contends that the accused has already been granted bail by the learned Court of Special Judge (SC/ST Act) Muzaffar Nagar (Uttar Pradesh), for the offences punishable under Sections 307, 34 and 414 of IPC and Sections 3/4/25/27 of the Arms Act; he has no previous criminal history; there is no independent witness of the alleged incident, the applicant not named in the FIR and is languishing in jail for the last one year.
6. On the contrary, learned State Counsel vehemently opposed the bail.

Considering the submission of learned counsel for the parties and for the fact that the accused have already been enlarged on bail for the offences punishable under Sections 307, 34 and 414 of IPC and Sections 3/4/25/27 of the Arms Act, without expressing any opinion as to the final merits of the case, this Court is of the view that application deserves bail at this stage.
8. Accordingly the bail application is allowed.
9. Let the applicant be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
