(2) This appeal, under Section 19 of the Family Courts Act, has been filed challenging the judgment and order dated 3.8.2022, passed by Judge, Family Court, Tehri Garhwal in Original Suit No. 81 of 2020. By the said judgment, suit for divorce on the ground of cruelty, filed by the husband (appellant), was dismissed.
(3) Today, the matter is listed on Miscellaneous Application (IA/3/2025), filed by the appellant. Along with the said application, a deed of compromise, allegedly entered into between appellant and respondent, has been enclosed. As per the compromise, both parties have agreed to live separately and the daughter Ms. Divya Negi, who was born on 9.12.2017, will reside with her mother. In para 13 of the compromise deed, it is mentioned that husband- appellant would pay rupees ten lakhs as alimony to the wife-respondent.
(4) Mr. Devang Dobhal, learned Counsel appearing for the respondent, concedes that parties have entered into a compromise and they have agreed to live separately.
(5) Learned Counsel for the appellant submits that since a compromise has been entered into between the parties, therefore, the appeal be disposed of in terms of compromise, granting liberty to the parties to approach the Family Court concerned by filing petition under Section 13-B of Hindu Marriage Act for divorce by mutual consent.
(6) Accordingly, this appeal is disposed of in terms of compromise, granting liberty to the parties to move a petition under Section 13-B of Hindu Marriage Act before the Court concerned.
