HIGH COURT OF UTTARAKHAND
NAND KISHORE TONDON – Appellant
Versus
STATE OF UTTARAKHAND – Respondent
WPMS 1723 / 2025

Office Notes, Date reports, orders or COURT’S OR JUDGE’S ORDERS proceedings or directions and Registrar’s order with Signatures D/15 WPMS No.1723 of 2025 Hon’ble Ravindra Maithani, J.

Ms. Shruti Joshi, Advocate for the petitioner.

Mr. Suyash Pant, Standing Counsel for the State/respondent nos.1 and 4.

Mr. Vipul Sharma, Advocate for respondent nos.2 and 3.

Learned counsel for the petitioner would submit that he was allotted a plot in the year 2004 by the Uttar Pradesh State Industrial Development Corporation at Bhimtal, District Nainital. Now, some persons are trying to grab the land.

By means of the instant petition, the petitioner seeks that the respondents may be directed to remove the unauthorized interference by the unknown land grabbers.

Related reliefs are also claimed.

Learned counsel appearing for the respondent no.2/ SIDCUL Uttarakhand would submit that based on the representation made by the petitioner, the land of the petitioner has already been demarcated. There is no encroachment on the property of the petitioner.

It is the claim of the petitioner that some persons are trying to encroach upon his land, which was allotted to him by SIDCUL Uttarakhand. This may give rise to a cause to file civil suit. In the writ petitions, such claims may not be decided. Even otherwise, on behalf of the respondent no.2/SIDCUL Uttarakhand, it is stated that the land of the petitioner has already been demarcated and there is no encroachment on it. In view of it, there is no merit in the writ petition. It stands disposed of accordingly.
