The court questioned the legal provisions under which the corpus was detained and raised concerns regarding the propriety of releasing an adult into the custody of a parent rather than setting them free. Ms. Snigdha Tiwari, learned counsel for the petitioner.

2. Mr. Pankaj Joshi, learned A.G.A. for the State.

3. Petitioner sought corpus of Mr. Prabhat Dhyani, who according to the learned counsel for the petitioner, has been illegally detained by Railway Police and Rishikesh Police, and thereafter by the Ramnagar Police.

4. Heard.

5. As soon as the matter is taken up, the learned counsel for the petitioner would submit that now she has received a telephonic call that police is going to release the corpus and document process is going on. She raised questions as to how the corpus could have been detained by the Uttarakhand Police?

6. The learned counsel for the State has initially sought some time to place the documents on record as to under what circumstances the corpus was detained. As the proceedings were underway, the learned State counsel submits that the corpus has been released and has been given in the custody of his mother, Mrs. Uma Dhyani.

7. The learned counsel for the petitioner submits that she has no such information as of now.

8. The learned State counsel shall place on record the entire document for the perusal of the Court which led to the apprehension and release of the corpus. The Court would also like to know as to why an adult is given into the custody of his mother and why he was not set free? The first and foremost question would be, under what circumstances and under what provisions of law, the corpus Prabhat Dhyani was detained ?
