Applicant Ramvir is in judicial custody in Case

Crime/FIR No. 102 of 2022, under Sections 8/20/29 of

the Narcotic Drugs and Psychotropic Substances Act, 1985

(“the Act”), Police Station Premnagar, District Dehradun.

He has sought his release on bail.

Heard learned counsel for the parties and

perused the record.

According to the FIR, on 04.04.2022, 1.76 kg.

charas was allegedly recovered from the possession of the

applicant and the co-accused, when they were moving in a

vehicle.

Learned counsel for the applicant would submit

that it is a false case. In the recovery memo, the police

officer has initially recorded that allegedly recovered article

was bhang and they confirmed it bhang after smelling it.

But subsequently, it is recorded in the recovery memo that
