The present applicants have been summoned

by the court of Chief Judicial Magistrate,

Uttarkashi, District Uttarkashi by an order dated

21.07.2022, to face the trial of Criminal Case No.

725 of 2022, State Vs. Ashwanth and Others,

wherein they have been called upon to be tried for

the offences under Section 420 and 406 of IPC,

which was registered against them by way of an

FIR no. 35 of 2021.

The learned counsel for the applicant had

attempted to address the court exercising its

jurisdiction under section 482 on the facts of the

case, which cannot be appreciated with regards to

the mathematical determination of the contractual

amount payable by the applicant to the workman.

All these questions will fall for consideration by the

trial court upon an appreciation of evidence. Apart
