FINAL ORDER
02.05.2024 FPA-ND-92,93&116/DLI/2017 A batch of three appeals were filed under Section 68-O of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘NDPS Act, 1985). It is to challenge the orders dated 01.02.2017 (in Appeal Nos.92 and 93/2017) and 10.08.2017 (in Appeal No.116/2017) passed by the Competent Authority and Administrator under the NDPS Act, 1985.
2. The counsel for the appellants submits that the Investigating Agency passed freezing orders attaching the properties of the appellants on registration of case for the offence under Sections 21, 29 and 61 of the NDPS Act, 1985. The case was registered by the Station House Officer (SHO), PS Nurpur, District Kangra on 09.11.2016 on the recovery of 14 Grams of Heroin from the possession of Smt. Rekha Devi along with her husband (now deceased) ShriSardari Lal. After registration of the case, the freezing/seized orders were passed by the SHO PS Nurpur on 08.01.2017 and 18.07.2017 which have been confirmed by the impugned orders dated 01.02.2017 and 10.08.2017. The following properties of the appellants (in Appeal Nos.92&93/2017) were subject matter of freezing/seizing order of the SHOdated 08.01.2017:
