FINAL ORDER

25.07.2024 FPA-PMLA-5387/CHD/2023 The appeal under Section 26 of the Prevention of Money Laundering Act, 2002 (in short `the Act of 2002’) has been filed to challenge the order dated 18.08.2022 passed by the Adjudicating Authority confirming the Provisional Attachment Order.

2. It is a case where after recording of ECIR 5/17, Provisional Attachment Order was passed on 12.11.2021 when a land property of the appellant was provisionally attached treating it to be ‘proceeds of crime’ to the tune of Rs.78,96,700/-. A challenge to the Provisional Attachment Order and its confirmation has been made by the appellant mainly on legal grounds but a reference of the facts has also been given to show that appellant is not involved in the crime thus,not named even as an accused yet his property has been attached. Other legal issues have also been raised which would be dealt with by us separately but before that we may refer to the brief facts of the case.
