MA No. 2027/2021

The present MA has been filed on behalf of the

respondents for taking on record the relevant judgment

of Hon’ble Supreme Court, i.e., Order/Judgment dated

05.03.2020 in SLP (C) No. 21803/2014 titled Union of

India and Ors. vs. M.V. Mohanan Nair(2020) 5 SCC

421 (Annexure – MA/2) and for final hearing of the

present OA.

2. For the reasons given therein in the MA and keeping

in view no objection from learned counsel for the

applicants, MA No. 2027/2021 is allowed to the extent

that the Order/Judgment dated 05.03.2020 of Hon’ble

Supreme Court, as annexed in Annexure – MA/2, be

taken on record.

With the consent of learned counsels for the parties,

OA is taken up for final hearing today itself.

2. Shri C. Bheemanna, learned counsel for the

respondents submits that the present OA was adjourned

sine die vide Order of this Tribunal dated 05.12.2019

(Annexure - MA/1), in view of pendency of the case, i.e.,

M.V. Mohanan Nair (supra) before the Hon’ble Apex

Court, however, the same has been decided by the

Hon’ble

Apex

Court

vide

Order/judgment

dated

05.03.2020 and nothing survives in the present OA. To

such submission made by Shri C. Bheemanna, learned

counsel for the respondents, Shri B. L. Wanchoo, learned

counsel for the applicants fairly admits the same.

3. Accordingly, in view of the aforesaid, the present OA

is dismissed. Pending MAs also stand disposed of.
