This review application has been filed by the

review applicant i.e. Food Corporation of India

(respondent no.2 in OA No.2501/2021) against the

order dated 17.11.2021 passed by this Tribunal in the

said OA.

At the outset, the review applicant has

submitted that as the service matters pertaining to the

review applicant i.e. Food Corporation of India, have

not been subjected to the jurisdcition of this Tribunal

under Section 14(2) of Administrative Tribunals Act,

1985, this Tribunal could not have entertained the

OA. It is further submitted that the respondent no.1 in

the OA i.e. Union of India, has been wrongly arrayed

as a party respondent, whereas it has no role to play

in

the

recruitment

commenced

under

the

advertisement

dated

27.02.2021

issued

by

the

respondent no.2 i.e. review applicant herein.

On perusal of the relevant provisions of the

Administrative Tribunals Act, it is clear that this

Tribunal has no jurisdiction over the service matters

pertaining to the review applicant.

4.

In these circumstances, the order dated

17.11.2021 passed in OA No.2501/2021 is recalled

and the OA stands rejected for want of jurisdiction.

However, the applicant in the OA shall be at liberty to

approach the appropriate legal forum.

5.

The review application is accordingly allowed

in circulation.
