1. This criminal revision is preferred against the judgment and order dated 12.11.2013 passed by the learned 2nd Additional Sessions Judge, Janjgir-Champa (C.G.) in Criminal Appeal No. 122/2012, arising out of the judgment of conviction and sentence dated 09.08.2012 passed by the learned Judicial Magistrate, First Class, Dhabhara in Criminal Case No. 263/2011, convicting the revisionist under Sections 457 and 354 of the Indian Penal Code (IPC) and sentenced him to undergo R.I. for 01 year with fine of Rs. 500/-, in default of payment of fine additional R.I. for 15 days, undergo R.I. for year with fine of Rs. 500/-, in default of payment of fine additional R.I.

for 15 days (all the sentences have been directed to be run concurrently).

2. The case of the prosecution in brief is that on 07/09/2011 at about

10:00 pm, the revisionist/accused had outraged the modesty of the complainant (PW-1) when she entered into her room with her nephew (Bhanja) by holding her hand with malice intention after committing lurking house trespass by night.
