1. This first anticipatory bail application under Section 438 of the Code of Criminal Procedure has been filed by the Applicant, who are apprehending his arrest in connection with Crime No. 213/2024 registered at Police Station – Vidhan Sabha, District- Raipur (C.G.) for the offence punishable under Sections 120B, read with 34, 420, 467, 468 and 471 of Indian Penal Code, 1860.
2. Prosecution case in brief is that complainant Hariballabh Agrawal is a partner of Mahamaya Construction and said partnership firm had land in village Saddu, wherein Khasra Nos. 63/2, 63/4, 65/1, 66/1, 66/2, 66/3, 66/4, 66/5, 315/3 & 315/4, admeasuring 2.770 Hectares. It is further stated that in the North and East direction of the aforementioned lands, land of Nemichand Makhija is situated bearing Khasra No. 67/1 & 67/2, admeasuring 0.458 Hectares, which has been purchased by him by a registered sale deed dated 16.05.1988. It was further alleged that said land has been sold to relatives and over those lands residential houses are constructed.
