1. This third bail application under Section 4 39 of the Code of Criminal Procedure filed by the applicant who is in custody in connection with Crime No. 33/2022 registered at Police Station – City Kotwali, District Bilaspur (C.G.) for the offence punishable under Sections 363 , 366(A), 370, 34 of IPC and Sections 4 , 6 of POCSO. The first bail application was dismissed as withdrawn in M.Cr.C. No. 5847/2022 vide order dated 05/08/2022. The second bail application was decided on merits on 15/02/2023 in M.Cr.C. No.10431/2022. 2. The case of prosecution in brief, is that on 17.11.2021, the prosecutrix went to typing class and she did not return, therefore, the mother of prosecutrix lodged a missing report doubted on one Jyoti Gupta.
