1. This is the irst bail application iled under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 129/2024 registered at Police Station Khairagarh, District – K.C.G (C.G.) under Section 20(b)

of the Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Case of the prosecution, in brief, is that on 21.03.2024 the Police of Police Station Khairagarh, District – K.C.G (C.G.) received a secret information that one person namely, Somnath Mandavi is indulged in illegal traicking of Ganja and is going towards Khairagarh from Sarangpur and it was also made known to the Police that while returning he would cross through Badhaitola and from where he would go to Sarangpur. In the turning point of Badhaitola proceedings of MCP (Mobile Check Post) were commenced and his motorcycle No. CG-08- AV-1484 was traced and was intercepted by Police after due formalities searched by Police and recovered 2.040 Kgs of Ganja from the said Mandavi, thereafter, on the basis of statement of the co-
