1. Applicant has filed this revision challenging the order dated

26.04.2023 passed in Case No.24 of 2022 by learned First Additional Sessions Judge/Special Judge (NDPS), Rajnandgaon (CG) whereby learned trial Court has framed charge under Section 21 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as “NDPS Act”).

2. Facts relevant for disposal of this revision are that the police received information that two cartons have been left at Rishabh Transport which was being taken over by the applicant (son of owner of Teekam Medical Stores). Based on the information, police intercepted the applicant along with Assistant Drug Controller and others at new Bus Stand premises in front of Alishan Hotel who was possessing two cartons. During search, they found 239 bottle of rexon syrup. Upon asking, the applicant told them that it was without any bill and he was arrested. After completion of investigation, police submitted charge sheet against the applicant for alleged commission of offence under Section 21 (b) of the NDPS Act.
