1. At the outset, learned counsel for the appellants submits that he is not pressing this appeal for appellant No.1. He may be permitted to withdraw the same with liberty to file the application for grant of regular bail before the Court below. He, however, submits that looking to the age of the appellant No.1 direction be issued to learned Court below and to consider and decide the appeal on the same date. He further submits that appellants No. 3 to 6 were arrested during the pendency of this appeal and, therefore, the appeal with respect to appellants No.
3 to 6 is rendered infructuous.
2. Submission made by counsel for appellants with respect to appellant No.1 is not opposed by counsel for State as also by the objector.
3. In view of the submission made by counsel for appellants with respect to appellant No.1 Sukhdev Lal S/o Late Bhagwan Datt Agrawal, his bail application is dismissed as withdrawn with liberty as prayed for. It is directed that in the event, appellant No.1 files an application for grant of regular bail before the Court below same may be considered, if possible, on the same day in accordance with law.
