1) Heard finally with the consent of the parties.
2) By way of this petition, the petitioner is questioning the legality and propriety of the order dated 04/03/2017 (Annexure P-1) passed by Board of Revenue, Bilaspur in case No. R.N./06/R/A-13/380/2015, whereby, the revision preferred by the Petitioner against the order dated 05/12/2014 (Annexure P-4) passed by the Additional Commissioner, Bilaspur has been dismissed and consequent upon that the orders passed by the revenue authorities allowing the application moved by the private respondents under Section 131 of the Chhattisgarh Land Revenue Code, 1959 (hereinafter referred to as “the Code, 1959”) has been upheld.
3) From perusal of the record, it appears that an application (Annexure P-5) was filed by the private respondents/villagers while invoking the provisions prescribed under Section 131 of the Code, 1959 as their right of way have been obstructed illegally by the petitioner for the last 4 months. On the basis of said application, the case was registered as Revenue Case No. 1/A-13/2010-11.
