THE APPELLATE TRIBUNAL :

Instant Appeal is arising out against an order dated 21/01/2019

passed by the Learned DRT-1, Hyderabad in O.A. No.172 of 2005

(Bank of Baroda -vs- K. Raghuram Reddy & Others) whereby IA

No.2916 of 2018 preferred by the Defendants Nos. 1, 2 & 3 for

condoning the delay of 1428 days in filing an application to set aside

the order dated 07.08.2014 dismissing the O.A. ex-parte.

Record shows that the Respondent Bank filed O.A. No.172 of

2005 against the instant appellants before the Ld. Tribunal below

wherein Summons were served upon the appellants. Even after service

of summons appellants No.3, who is guarantor of the loan, did not put

in appearance, as such O.A. was proceeded ex-parte on 11
