1. The present appeal is preferred against the impugned award dated

14.08.2010 whereby, the learned Tribunal has granted compensation for

a sum of Rs.11,48,176/- with interest at the rate of 7.5% per annum

from the date of filing of the petition till realization of the amount.

2. Learned counsel appearing on behalf of the appellant/Corporation

submitted that the learned Tribunal has erred in holding that the

respondents are the actual legal heirs of the deceased Gabruddin @

Jafruddin @ Mullah in absence of any documentary proof, in as much as,

there is no document on record to show that the deceased Gabruddin @

Jafruddin @ Mullah was Gaffar Khan.

3. It is submitted that in the post-mortem report Ex.PW2/5, name of

the deceased was mentioned as Jafruddin @ Gabruddin @ Mu
