Heard counsel for the petitioner and the learned

A.P.P. for the State.

The petitioner seeks regular bail in connection with

Baisi P.S. Case No. 237 of 2021 lodged under Section 272 and

273 of the Indian Penal Code, 1860 and Section 30(a)/41/47 of

Bihar Prohibition Excise Act, 2016.

As per the allegation made in the F.I.R., about 1350

liters of wine has been recovered from the vehicle (Truck).

It has been argued by the learned counsel for the

petitioner that petitioner is innocent as he is cleaner of the truck.

He further submits that charge sheet has already been submitted

in this case whereas the petitioner is in custody since

17.08.2021.

Learned A.P.P. has opposed the prayer for bail.

Considering the facts of the case and after perusal of

the records as well as this aspect that charge sheet has already

been submitted and petitioner is in custody since 17.08.2021, let

the petitioner above named be granted bail on furnishing bail

bond of Rs.10,000/- (Ten Thousand) with two sureties of the

like amount each to the satisfaction of learned Additional

District & Sessions Judge-II-cum-Special Judge, Excise Act,

Purnea in connection with Baisi P.S. Case No. 237 of

2021(Special Case No.273 of 201).

Subject to the condition that one of the bailors shall be

close relative of the petitioner.
